MISSION STATEMENT
MyHealthSquad is a directory of health professional offering various services related to Complementary Medicine (CM), Complementary and Alternative Medicine (CAM), Integrated Medicine or Integrative Medicine (IM) and Holistic Medicine.
MyHealthSquad’s mission statement is to connect “web user” (clients) to a variety of health professional (Members) in their geographical area based on specific needs, symptoms and pathologies. Our main business purpose is to promote economic opportunities for our listed “Members” by enabling them visibility to the market place.
We are not health professional and all of the information on this website and related to MyHealthSquad products and services are provided for informational purposes only.
In this document, the use of the brand “MyHealthSquad” referred also to the website “MyHealthSquad.ca”. MyHealthSquad may also use different domain names that are pointed to MyHealthSquad.ca. For the purpose of this document and all communication, only “MyHealthSquad” will be use.
1.1
WHO MAY USE THIS SERVICE
You may use the Services (as a web user or as a Member) only if you agree to form a binding contract with MyHealthSquad and are not a person barred from receiving services under the laws of the applicable jurisdiction. In any case, you must be at least 18 years old to use the Services. If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to such entity.

User’s type
Web User (also called patient, client, visitor): You use MyHealthSquad for free for the purpose of seeking information about various Complementary Medicine Health professional provider and their services.
Member (professional service provider): You use MyHealthSquad as a paid listing service for the purpose of promoting your products and services to the market place.

As a Web User, you agree to the following:
MyHealthSquad may access, store, process and use any information and personal data that you provide.
You agree that MyHealthSquad is not a substitute for professional medical advice, diagnosis or treatment. If you have or suspect to have a health problem, you should consult your family physician. If you have or suspect you are experiencing a health emergency, it is highly recommended you should visit a hospital Emergency Department in your area. Reliance on any information provided by MyHealthSquad appearing on or provided in relation to the website is solely at your own risk. MyHealthSquad assumes no responsibility or liability for any damages, claims, liabilities, costs or obligations arising from the use of this website or any other website to which this site is linked. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.
MyHealthSquad does not endorsed or recommend the quality of the services provided by any of its members, their employees or associated or stakeholders. Furthermore, MyHealthSquad and all its subsidies, associates, contractors, consultants, employees, parent companies and other related partners cannot be held responsible for any misrepresentations, errors and/or malpractices on behalf of its listed members (health professional provider).
You are not allow to advertise, mention or communicate in any shape of form that any members (professional health service provider) being listed on MyHealthSquad is endorse or approve for their quality of their products or services by MyHealthSquad.
Furthermore:
- You are not allow to develop,support or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plugins and add-ons, or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
- You are not allow to override any security feature or bypass or circumvent any access controls or use limits of the Service
- You are not allow to copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties without the consent of MyHealthSquad;
- You are not allow to disclose information that you do not have the consent to disclose (such as confidential information of others;
- You are not allow to violate the intellectual property or other rights of MyHealthSquad, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology; (iii) using the word “MyHealthSquad” or our logos in any business name, email, or URL except as provided in the Brand Guidelines;
- You are not allow to post anything that contains software viruses, worms, or any other harmful code;
- You are not allow to reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
- You are not allow to imply or state that you are affiliated with or endorsed by MyHealthSquad without our express consent;
- You are not allow to rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to this Service, without MyHealthSquad consent;
- You are not allow to deep-link to our Services for any purpose other than to promote your profile on our Services, without MyHealthSquad consent;
- You are not allow to use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;
- You are not allow to monitor the Services’ availability, performance or functionality for any competitive purpose;
- You are not allow to be engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
- You are not allowed to overlay or otherwise modify the Services or their appearance;
- You are not allow to interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms).
3.0
As a Member (professional service provider),
You agree that by clicking “Join Now”, you are agreeing to enter into a legally binding contract with MyHealthSquad (even if you are using our Services on behalf of a company). If you do not agree to this contract (User Agreement), do not click “Join Now” and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.
To use the Service, you agree to the following:
You must be the “Minimum Age” (described above) or older;
You will only have one MyHealthSquad account, which must be in your real name;
You are not already restricted by MyHealthSquad from using the Service. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 18.
You also agree and understand that MyHealthSquad and all its subsidies, associates, contractors, consultants, employees, parent companies and other related partners cannot be held responsible for any misrepresentations on your behalf.
MyHealthSquad does not guarantee any sales results, any references or any increase in sales and/or visibility. By having your company, your name and your services listed on MyHealthSquad does not represent an endorsement of the quality of the services you provided by MyHealthSquad and its partners and stakeholders. Therefore, you are not allowed to engage in such practice in any shape of form.
You agree and understand that MyHealthSquad is not a substitute for professional medical advice, diagnosis or treatment. If any of your client or reference have or suspect have a health problem, they should consult their family physician. If they have or suspect they are experiencing a health emergency, it is highly recommended they should visit a hospital Emergency Department in their area. MyHealthSquad assumes no responsibility or liability for any damages, claims, liabilities, costs or obligations arising from the use of this website or any other website to which this site is linked. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.
Use the Services in a professional manner; Provide accurate information to us and keep it updated and Use your real name on your profile.
You agree that you will NOT:
Create a false identity on MyHealthSquad, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use another’s account;
Furthermore, you are not allow to:
- Develop, support or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plugins and add-ons, or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
- Override any security feature or bypass or circumvent any access controls or use limits of the Service (such as caps on keyword searches or profile views);
- Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties without the consent of MyHealthSquad;
- Disclose information that you do not have the consent to disclose;
- Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission.
- Violate the intellectual property or other rights of MyHealthSquad, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology; (iii) using the word “MyHealthSquad” or our logos in any business name, email, or URL;
- Post anything that contains software viruses, worms, or any other harmful code;
- Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
- Imply or state that you are affiliated with or endorsed by MyHealthSquad without our express consent (e.g., representing yourself as an accredited MyHealthSquad trainer or associate);
- Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without MyHealthSquad consent;
- Deep-link to our Services for any purpose other than to promote your profile on our Services, without MyHealthSquad consent;
- Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;
- Monitor the Services’ availability, performance or functionality for any competitive purpose;
- Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
- Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services);
- Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms).

Your Account
You will keep your password a secret.
You will not share an account with anyone else and will follow our rules and the law.
As a Members you are considered an account holder. You agree to: (1) try to choose a strong and secure password; (2) keep your password secure and confidential; (3) not transfer any part of your account; (4) follow the law and (5) You are responsible for anything that happens through your account unless you close it or report misuse in a timely fashion.
As between you and others (including your employer), your account belongs to you. However, if the Services were purchased by another party for you to use, the party paying for such Service has the right to control access to and get reports on your use of such paid Service. In case of your dismissal, the owner of the account has the right to assign your access to another user.
4.0
Payment
You will honor your payment obligations and you agree with us storing your payment information. You understand that there may be fees and taxes that are added to our prices.
If you buy any of our paid Services, you agree to pay us the applicable fees and taxes and to additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that:
All our transactions are made in Canadian dollars. We may store and continue billing your payment method (e.g. credit card) even after it has expired, to avoid interruptions in your Services and to use to pay other Services you may buy;
If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, we must receive a cancellation notice 30 days prior to the expiration of your subscription by email at finance@myhealthsquad.com.
We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.
5.0
Change
We may modify this Contract from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you may close your account. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms.
5.1
Notices and Messages
You agree with us providing notices and messages to you through our websites, apps, and contact information. If your contact information is out of date, you may miss out on important notices.
You agree that we will provide notices and messages to you in the following ways: (1) within the Service, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

Rights and Limits
Your License to MyHealthSquad
You own all of the content, feedback, and personal information you provide to us, but you also grant us a non-exclusive license to it.
By joining MyHealthSquad listing service, you confirmed that you are a registered professional providing services in the designated type of service advertised. You confirmed that your registration is active and confirmed by the governing body or association, school, bureau, registration office of your profession.
You confirmed that you do not have any legal issue regarding the practice of your profession, that you don’t have any malpractice case against you – pending or confirmed.
You own the content and information that you submit or post for MyHealthSquad and you are only granting MyHealthSquad and our affiliates the following non-exclusive license:
- A worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish, and process, information and content that you provide through our Services and the services of others, without any further consent, notice and/or compensation to you or others. These rights are limited in the following ways:
- You can end this license for specific content by deleting such content from the Services, or generally by closing your account, except (a) to the extent you shared it with others as part of the Service and they copied, re-shared it or stored it and (b) for the reasonable time it takes to remove from backup and other systems.
We will not include your content in advertisements for the products and services of third parties to others without your separate consent (including sponsored content). However, we have the right, without payment to you or others, to serve ads near your content and information, and your social actions may be visible and included with ads.
While we may edit and make format changes to your content (such as translating it, modifying the size, layout or file type or removing metadata), we will not modify the meaning of your expression.
By submitting suggestions or other feedback regarding our Services to MyHealthSquad, you agree that MyHealthSquad can use and share (but does not have to) such feedback for any purpose without compensation to you.
You agree to only provide information and content that you have the right to share, and that your MyHealthSquad profile will be truthful.
You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). You also agree that your profile information will be truthful. MyHealthSquad may be required by law to remove certain information or content.
6.1
Service Availability
We may change, suspend or end any Service, or change and modify prices prospectively in our discretion. To the extent allowed under law, these changes may be effective upon notice provided to you.
MyHealthSquad is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.
6.2
Other Content, Sites and Apps
Your use of others’ content and information posted on our Services, is at your own risk.
By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. MyHealthSquad generally does not review content provided by our Members or others. You agree that we are not responsible for others’ (including other Members’) content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse. You also acknowledge the risk that you or your organization may be mistakenly associated with content about others when we let connections and followers know you or your organization were mentioned in the news.
6.3
Intellectual Property Rights
MyHealthSquad reserves all of its intellectual property rights in the Services. Using the Services does not give you any ownership in our Services or the content or information made available through our Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners.
6.4
Automated Processing
The main purpose of our Service is to connect Web User with Members like you. In order to operate and “fulfill our obligation” to you to promote economic opportunities by enabling you visibility to the market place, we use data and information about you to make relevant suggestions to our web user.
We will use the information and data that you provide and that we have about Members to make recommendations for connections, content and features that may be useful to you. For example, we use data and information about you to recommend Clients to you. Keeping your profile accurate and up-to-date helps us to make these recommendations more accurate and relevant.
6.4.1
Registration and Account Information
We may collect and store the information you used when registering for the site, including your first name, last name, e-mail address, and for health professionals business name, address, phone number, e-mail address. We may, in the future, requests further information from you and supplement Personal Information you provide us with additional information purchased from third parties for marketing purposes.
6.4.2
Password
You agree that you will be responsible for maintaining your password as confidential and we are not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.
6.5
Online Surveys, Contests and Advertising
Occasionally, we may send out user experience surveys or contests. You responses will be treated in accordance with this Privacy Policy. Information we gather through a contest may also be disclosed to third parties as necessary for prize fulfillment and other aspects of any contest or similar offering. We may also run co-branded contest or survey with a partner, unless the survey or contest terms provide otherwise, information that you provide to that contest or survey may be provided to that partner, after which it will be subject to that partner’s privacy policy.

User-Submitted Information
We reserve the right to retain any and all information submitted by Users through use of the Site and we may supplement Personal Information you provide us with additional information purchased from third parties for marketing purposes.

Automatically Gathered Information
We automatically collect information including but not limited to, browser type, browser software version, browser characteristics, IP address, location information, type of computer or mobile device, mobile carrier, unique device identifier, requesting and referring URLs and other information that may personally identify you ("Automatically Gathered Information"). We reserve the right to collect and manage this information at our discretion. We may use cookies, web beacons, and other tracking technologies ("Tracking Technologies") to conduct research and analytics, to maintain records of Users' activities on our Site, to manage use of our Site and Site services (including third party services), to deliver advertisements to you or otherwise customize and improve your user experience, and as deemed necessary for additional Site management purposes.
Additionally, we can and will use IP addresses to identify a User when we, in our sole discretion, determine that it is necessary to enforce compliance with the Site Terms of Use or Privacy Policy, or to protect our service, Site, customers, vendors, or others. We may combine your Automatically Gathered Information with your Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.
6.7.1
Public Information
Member profiles will be publicly available as a default. Members may update this option in Privacy Settings. If you change your Privacy Settings, some information that was previously public may remain cached and publicly available temporarily or indefinitely by search engines and others who archive publicly available content.
6.8
Site Transactions and Administration
For internal purposes, personal information may be used to contact you via email or telephone to inform you about updates to our Services and providing you with information relating to e-commerce transactions you conducted on the Site. We also reserve the right to disclose your information as described in the paragraphs below.
6.8.1
Contractors
We may provide your Personal Information to third party contractors who work on behalf of or with Us to provide you with site services. These contractors do not have any independent right to share your Personal Information.
6.8.2
Affiliates
My Health Squad has or may have other companies under a common control and we may share some or all of your Personal Information with these Affiliates. Affiliates honour this Privacy Policy.
6.8.3
Legal Requests
We may disclose information about you if we believe in good faith that such disclosure is necessary to comply with relevant laws including subpoenas or warrants served on us; or protect or defend Our rights, property, privacy or safety, our affiliates, you or others.

Acquisition
If our company or all or any portion of our assets related to the Site are acquired by another company that company will possess the Personal Information collected by us and it will assume the rights and obligations regarding your Personal Information.

Disclaimer and Limit of Liability
TO THE EXTENT ALLOWED UNDER LAW, MYHEALTHSQUAD AND ITS AFFILIATES (AND THOSE THAT MYHEALTHSQUAD WORKS WITH TO PROVIDE THE SERVICES) (A) DISCLAIM ALL IMPLIED WARRANTIES AND REPRESENTATIONS (E.G. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NONINFRINGEMENT); (B) DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS, AND (C) PROVIDE THE SERVICE (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS.
SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OR ALL OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.
7.1
Exclusion of Liability
TO THE EXTENT PERMITTED UNDER LAW (AND UNLESS MYHEALTHSQUAD HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT OVERRIDES THIS CONTRACT), MYHEALTHSQUAD AND ITS AFFILIATES (AND THOSE THAT MYHEALTHSQUAD WORKS WITH TO PROVIDE THE SERVICES) SHALL NOT BE LIABLE TO YOU OR OTHERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES, RELATED TO THE SERVICES (E.G. OFFENSIVE OR DEFAMATORY STATEMENTS, DOWN TIME OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT).
IN NO EVENT SHALL THE LIABILITY OF MYHEALTHSQUAD AND ITS AFFILIATES (AND THOSE THAT MYHEALTHSQUAD WORKS WITH TO PROVIDE THE SERVICES) EXCEED, IN THE AGGREGATE FOR ALL CLAIMS, AN AMOUNT THAT IS THE LESSER OF (A) THREE TIMES THE MOST RECENT MONTHLY OR YEARLY FEE THAT YOU PAID FOR A PREMIUM SERVICE, IF ANY, OR (B) $500.
THIS LIMITATION OF LIABILITY IS PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND MYHEALTHSQUAD AND SHALL APPLY TO ALL CLAIMS OF LIABILITY (E.G. WARRANTY, TORT, NEGLIGENCE, CONTRACT, LAW) AND EVEN IF MYHEALTHSQUAD OR ITS AFFILIATES HAS BEEN TOLD OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF THESE REMEDIES FAIL THEIR ESSENTIAL PURPOSE.
SOME LAWS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SO THESE LIMITS MAY NOT APPLY TO YOU.
7.2
Termination
We can each end this Contract anytime we want with the following rules:
- CLAUSE THAT YEARLY CONTRACT ARE NOT REFUNDABLE, MONTHLY CONTRACT TERMINATION MUST BE TERMINATED WITH A 30-DAYS WARNING.
You and MyHealthSquad may terminate this Contract at any time with notice to the other. On termination, you lose the right to access or use the Services. The following shall survive termination:
Members and/or web user’s rights to further re-share content and information you shared through the Service to the extent copied or re-shared prior to termination;
8.0
Governing Law and Dispute Resolution
This agreement is governed by the Ontario Law and by the laws of the Province of Ontario, Canada without regard to conflict of laws principles that would require the application of the laws of another jurisdiction.
9.0
General Terms
To the extent allowed by law, the English language version of this Contract is binding and other translations are for convenience only. This Contract (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.
If we don't act to enforce a breach of this Contract, that does not mean that MyHealthSquad has waived its right to enforce this Contract. You may not assign or transfer this Contract (or your membership or use of Services) to anyone without our consent. However, you agree that MyHealthSquad may assign this Contract to its affiliates or a party that buys it without your consent. There are no third-party beneficiaries to this Contract.
